Rising Litigation Trends in Australia: How to Safeguard Your Business

September 18, 2024

On the 10th of September, APAN CEO Tina Viney was invited to attend the Inaugural Expert Witness Symposium 2024 in Sydney.

The event brought together some of Australia’s most notable legal experts such as the Hon. Justice E A Cheeseman, Federal Court of Australia and the Hon. T Bathurst AC KC – former Chief Justice, Supreme Court of NSW.

The event discussed how industries are progressively becoming more specialised, contributing to the growing complexities of litigation in Australia and the need for both the courts and lawyers to work with industry experts. The importance of ethical and unbiased information on which cases can be judged was stressed.

Over 350 experts and lawyers attended the event which delivered an incredible program on

  • Challenges and Best Practices in the Future of Expert Testimony
  • Assumptions
  • Expert Witness Selection and Responsibilities
  • Legal Professional Privilege
  • Expert Independence
  • Concurrent Evidence and Cross-Examination

Relevance to the aesthetics industry

  • Through her extensive involvement over several years with litigation cases Tina Viney was able to directly identify recurring incidences of adverse reactions and determine specific recurring factors that are contributing to many of these cases.

“As my priority is to use my expertise to protect our industry, I was able to bring this data across to benchmark the development of protective protocols and precautionary measures against the risk of burns and adverse reactions,” Tina confirmed.

This valuable experience has contributed to the launch of the Apan risk management policies and procedures for phototherapy treatments.

  • We highly recommend that this document should be accessed by any business or practitioner who provides laser, IPL or other phototherapy treatments, or procedures that can potentially contribute to reactions.
