Brand-New Legislation Laws Prohibit Pay Secrecy

January 23, 2023

This week we received notification from the FairWork Ombudsman regarding the new laws about pay secrecy and what can be included in job advertisements.

These changes are part of the Australian Government’s new Secure Jobs, Better Pay legislation that was passed in December 2022.

The new laws include:

  • Giving employees the right to share (or not share) information about their pay.
  • Banning pay secrecy terms in employment contacts and other workplace instructions.
  • Prohibiting job ads with pay rates lower than the legal minimum entitlements that apply to the job.

These changes apply now, with some transitional arrangements.

The Fair Work Ombudsman website has been expanded updating its resources in relation to these changes.

You can access a job advertisement template that provides employees with guidelines to meet the new replacement laws.
